12. Allegations against employee or councillor

If there is an allegation that an employee or councillor has not followed this policy and therefore may have put themselves, the council or a vulnerable adult at risk it will be dealt with in accordance with the disciplinary procedure, or code of conduct procedure for councillor.

If there is an allegation that an employee has abused a vulnerable adult in the course of their employment Devon County Council's arrangements for allegations against professionals shall be instituted via  the head of housing. The employee may be suspended immediately from activities involving vulnerable adults while an investigation takes place.  There may be three types of investigation carried out:

  • criminal investigation
  • adult protection investigation
  • disciplinary investigation (code of conduct procedure for councillor)

Irrespective of the findings of other investigations, if following any disciplinary action, the council has a reasonable belief that an employee did abuse a child, young person or vulnerable adult then this may be regarded as gross misconduct, and it will be necessary to consider reporting this to the independent safeguarding authority.
