2. What is the CIL Examination

The Community Infrastructure Levy Regulations 2010 (as amended) require authorities to submit a draft charging schedule and associated documents and evidence for independent examination prior to adopting a charging schedule and subsequently starting to charge CIL.

The examination is to ensure that the charging schedule has been produced in line with the CIL Regulations and the Planning Act 2008. A key test of the examination is to ensure that the charges proposed in the charging schedule do not put development of the area as a whole or the delivery of the Local Plan at risk.

The examination is carried out by an independent examiner appointed by the authority.
