26. Membury (made)

Adoption

A report was taken for Senior Officer Urgent Decision on 27 April 2020 recommending that the Membury Neighbourhood Plan be 'made' so that it forms part of the Development Plan for East Devon. 

The date of 'making' the Plan is 27 April 2020. This is following the successful referendum on 12 March 2020 where 81% of residents who voted were in favour of adopting the Plan.

Referendum

On 12 March 2020, a referendum was held on the Membury Neighbourhood Plan where residents were asked the following question:

"Do you want East Devon District Council to use the Neighbourhood Plan for Membury to help it decide planning applications in the neighbourhood area?"

The results are as follows:

Number cast in favour of a 'YES'

Number cast in favour of a 'NO'

Turnout: 33.5%

Examiner's Report

Post-examination Further Consultation

Following consideration of the Examiner's report, the Parish Council resolved to accept his recommendations subject to a minor amendment to Policy HP1, reducing the maximum cumulative number of new builds across the parish from 15 to 10.

The District Council supported this amendment in principle, and undertook consultation from 29th November 2019 to 10th January 2020. This consultation only related to the proposed amendment as set out in the notice.

No objections were received so the Plan will now proceed to Referendum.

Examination

Andrew Mead was appointed to examine the Membury Neighbourhood Plan. The process commenced on the 16 March 2018.  The report is now available.

Following an initial assessment, the Examiner produced a Procedural Matters document including questions to the Parish Council and East Devon District Council.

Membury Submission of Plan to Local Authority - Regulation 16

Membury Parish Council as the qualifying body have prepared and submitted the Membury Development Plan to East Devon District Council.  The plan was out to consultation until 16 March 2018.  A full list of responses to the consultation can be seen below:

Health Check

Following the production of a draft Neighbourhood Plan, East Devon District Council commissioned the undertaking of a Neighbourhood Plan Health Check, which was conducted by John Slater, an experienced planning professional who has undertaken examinations of Neighbourhood Plans across the Country.

Neighbourhood Area Designation

Membury Parish Council requested the whole of their parish be designated a neighbourhood area.  The designation was approved on 2 April 2014.
