On 28 June 2017 the East Devon Villages Plan, including supporting evidence and consultation responses, was submitted to the Secretary of State for Communities and Local Government (via the Planning Inspectorate).

The Council's Submission Statement

The East Devon Villages Plan will guide development in certain East Devon settlements.  Please note that the main document that sets out the planning strategy for East Devon is the East Devon Local Plan 2013 - 2031, which was adopted in 2016.

Receipt of Inspector's Report

We have received the Report on the Examination of the East Devon Villages Plan from the Inspector.  This concludes that the Plan is sound and legally compliant subject to main modifications.  It is intended that the Inspector's report will be considered at the meeting of the Strategic Planning Committee on 26 June 2018 before the Villages Plan is considered for adoption at the Full Council meeting on 25 July 2018.  The modifications should be read alongside the Villages Plan that was submitted for Examination.

Consultation on proposed Main Modifications

The Inspector has asked the Council to undertake a consultation on a schedule of proposed main modifications and an updated Sustainability Appraisal/Strategic Environmental Assessment incorporating the main modifications (SA/SEA).  A non-technical summary of the SA/SEA has also been prepared.

The consultation period ran from 18 December 2017 until 02 February 2018. 

An updated version of the East Devon Villages Plan has been prepared to provide the context for the proposed main modifications, but it is only the schedule of proposed main modifications and the updated SA/SEA that are being consulted on and any comments should relate to these documents rather than to other parts of the plan not included in the proposed main modifications.

All representations received by 02 February 2018 have been sent to the Inspector for consideration before she prepares her final report on the plan, expected during Spring 2018.

Inspector

Planning Inspector; Beverley Doward BSc BTP MRTPI has been appointed to undertake an independent examination into the soundness of the East Devon Villages Plan.

The Inspector’s task is to consider the soundness of the submitted Plan, based on the criteria set out in paragraph 182 of the National Planning Policy Framework (the Framework).  The relevant soundness criteria are whether the Plan is: 1 – positively prepared (based on a strategy that seeks to meet objectively assessed development and infrastructure requirements, including unmet requirements from neighbouring authorities where it is reasonable to do so and consistent with achieving sustainable development); 2 - justified (the most appropriate strategy when considered against the reasonable alternatives, based on proportionate evidence); 3 – effective (the Plan should be deliverable over its period and based on effective joint working on cross-boundary strategic priorities); and 4 – consistent with national policy (the Plan should enable the delivery of sustainable development in accordance with the policies in the Framework). 

The Inspector will take into account the representations submitted upon the Plan as far as they relate to soundness considerations. A number of informal debates will take place on the principal matters identified by the Inspector these are termed Hearing Sessions.

Following the closure of the Examination, the Inspector will prepare a report to the Council with precise recommendations, these recommendations may include modifications to the Plan, if such a request is made by the Council.

Guidance Notes have been prepared by the Inspector to help people understand the process.  Any queries people may have regarding the Examination process should be directed to the Programme Officer who will be happy to assist.

The Planning Regulations require that, at least 6 weeks before any hearing, all those who made comments on the East Devon Villages Plan consulted on from 22 March 2017 until 10 May 2017 were notified of the name of the Inspector and the date, time and place of hearings.

To comply with this requirement the Programme Officer sent an email where possible and a letter to those without email addresses.

Hearing Sessions were held on Tuesday 7 and Wednesday 8 November 2017 within the Council Chamber of East Devon District Council, Knowle, Sidmouth, Devon, EX10 8HL.
