Service Apply for a minor variation to a premises licence

How to apply
If you want to apply for a minor variation to your premises licence then you can do this online.
You'll need to give:
- an explanation of the variation
- a detailed plan if you are changing the layout of the premises - you can find out more about this in our guidance for plans
- details of any further steps you'll take to promote the four licensing objectives (these will be attached to your licence as conditions and you may find our Pool of Conditions - GN6 guidance helpful with this)
You don't need to serve a copy of your application on any other responsible authorities. However, please be aware that we will consult with relevant responsible authorities if there is any doubt about the impact of the variation on the licensing objectives or, if we consider that a responsible authority may have an interest in the application. This could include the Home Office (Immigration Enforcement).
Notices
You must put up public notices at the premises with details of the application.

Payments
You'll be charged a fee for this application. Please make sure you are aware of how much this will cost.
Data Protection
Any personal information which you provide will be held and used by East Devon District Council for the purpose of the licensing service to process your application for a minor variation and administer any related premises licence. Your information may also be shared within East Devon District Council for the purposes of carrying out our lawful functions. Otherwise your personal information will not be disclosed to anybody outside East Devon District Council without your permission, unless there is a lawful reason to do so, for example disclosure is necessary for crime prevention or detection purposes. Your information will be held securely and will not be retained for any longer than is necessary. There are a number of rights available to you in relation to our use of your personal information, depending on the reason for processing. You'll need a credit or debit card.
You'll need a plan of the premises if you are changing the layout.
You'll need to send us your existing premises licence in the post.
You'll need to put public notices up at the premises.
When we receive your application we'll check it to make sure it's been completed correctly. We'll telephone you if there is anything else we need.
As soon as we have the complete application and all the information we need, we'll accept it and there will then be 10 working days (starting on the first working day after the application is accepted) when anyone can make a representation.
Please be aware that, we will consult with relevant responsible authorities if there is any doubt about the impact of the variation on the licensing objectives or, if we consider that a responsible authority may have an interest in the application. This could include the Home Office (Immigration Enforcement).
When the representation period has ended, we will consider the application, taking into account the views of any responsible authorities and any relevant representations received, to decide whether the application should be granted or refused.
We will reject any applications that threaten the licensing objectives.
If the application is granted we'll send you your licence in the post.
If the application is refused you'll need to re-apply for a full variation of your premises licence. If representations are received against that full variation application it will be decided by a hearing of the licensing sub-committee.
What you can do if you haven't heard from us
We have 15 working days from the day after we accept your application to decide whether to grant it. If you haven't heard from us after 15 working days then you should regard the application as refused. You can contact us by email or telephone for an update.

Appeals
If an application for a minor variation is refused then there is no right of appeal. Instead you can either re-apply with an amended minor variation application or apply for a full variation of your premises licence. We are able to carry over the original fee towards the following application.
