8. Supplier’s personnel

8.1          If and when reasonably instructed by the Buyer, the Supplier shall give to the Buyer a list of all persons who are or may be at any time concerned with the Service, or any part of it, specifying the capacities in which they are so concerned, and giving such other supporting evidence as the Buyer may reasonably require to enable the Buyer to identify the Supplier’s representatives.

 

8.2          The Supplier shall take all reasonable steps, as required by the Buyer, to prevent unauthorised persons being admitted to that part of the Facility related to the Service in the course of the delivery of the Supplier’s obligations under the Contract. If the Buyer instructs the Supplier, giving reasons, that any particular person is not to be admitted to or is to be removed from the Facility, or part thereof, or is not to become involved in or is to be removed from involvement in the performance of the Contract, the Supplier shall take all reasonable steps to comply with such notice and, if required by the Buyer, the Supplier shall replace any such person removed under this Condition with another suitably qualified person and shall ensure that the person so removed is not allowed any future access to the Facility or further involved in the supply of the Service.

 

8.3          The decision of the Buyer as to whether any person is to be admitted to or is to be removed from the Facility or is not to become involved in or is to be removed from involvement in the performance of the Contract, and as to whether the Supplier has furnished the information or taken the steps required of it by this Condition, shall be final and conclusive.

 

8.4          The Supplier shall bear the cost of any notice, instruction or decision of the Buyer under this Condition.
