24. Luppitt (made)

Adoption

On 12 January 2023, East Devon District Council decided to ‘make’ (adopt) the Luppitt Neighbourhood Plan.  This means that it now forms part of the Development Plan for East Devon alongside any other made neighbourhood plans, the adopted East Devon Local Plan 2013-2031, and the Devon Minerals and Waste Plan.

This was following the successful referendum on 24 November 2022, where 89% of residents who voted were in favour of the Plan.

The Luppitt Neighbourhood Plan as 'made' is available to view.

Our Decision Statement and Compliance Statement confirms the Plan as made and legally compliant.

The Plan will be used to help make decisions on planning applications and guide future development in the parish of Luppitt.

Referendum

A local referendum was held on 24 November 2022 on the Luppitt Neighbourhood Plan.  The referendum asked residents in the parish of Luppitt the following question:

"Do you want East Devon District Council to use the Neighbourhood Plan for Luppitt to help it decide planning applications in the neighbourhood area?"

The results, confirmed in the published Declaration, are as follows:

Number cast in favour of a 'YES':

102 (89%)

Number cast in favour of a 'NO':

13 (11%)

Turnout: 29%

Examination

The Luppitt Neighbourhood Plan was examined by independent examiner Mary O'Rourke in 2022.  The conclusions of the examination were that, subject to a number of amendments, the Plan could proceed to referendum.  The Examiner's Final Report is now available to view.

In undertaking the examination, the Examiner considered a full set of Plan documentation, including all responses to the recent Submission consultation (shown further below) and the EDDC Strategic Environmental Assessment (SEA) and Habitats Regulations Assessment (HRA) Screening Opinion.  In addition, consideration was given to responses from Luppitt Parish Council/Neighbourhood Plan group and East Devon District Council to questions posed by the Examiner, and to a late representation relating to these questions by Mrs H Plummer

The Plan was updated in line with the examiner’s recommendations.  As modified, it was assessed as meeting the necessary 'basic conditions'.   This was confirmed by formal decision of East Devon District Council in October 2022 recommending the Plan to go forward for referendum.

Submission (Regulation 16)

Luppitt Parish Council (as the qualifying body) prepared and submitted the Luppitt Neighbourhood Development Plan to East Devon District Council in February 2022.  The District Council held a consultation on the Submission for just over 6 weeks, from 22nd March to midnight Friday 6th May 2022.

The District Council undertook a Legal Compliance Assessment of the submission.  This assessed the Plan as able to proceed to this next stage of formal consultation (known as Regulation 16).  The formal Notice of the consultation confirms the details.

Pre-Submission Consultation (Regulation 14)

Luppitt Parish Council consulted for a total of 7 weeks on the pre-submission version of their Neighbourhood Plan, ending 9th April 2021.

The Plan was considered in the light of the consultation responses and a Submission Version agreed by the Parish Council.

Designation

Luppitt Parish Council requested the whole of their parish be designated a neighbourhood area. On 30 October 2013 Luppitt was designated a neighbourhood area.
