15. Dalwood (made)
Adoption
On 30 March 2022, East Devon District Council decided to ‘make’ (adopt) the Dalwood Neighbourhood Plan. This means that it now forms part of the Development Plan for East Devon alongside any other made neighbourhood plans, the adopted East Devon Local Plan 2013-2031, and the Devon Minerals and Waste Plan.
This was following the successful referendum on 24 February 2022, where 95% of residents who voted were in favour of the Plan.
The Dalwood Neighbourhood Plan as 'made' is available to view.
Our Decision Statement and Compliance Statement confirms the Plan as made and legally compliant.
The Plan will be used to help make decisions on planning applications and guide future development in the parish of Dalwood.

Referendum
A local referendum was held on 24 February 2022 on the Dalwood Neighbourhood Plan. The referendum asked residents in the parish of Dalwood the following question:
"Do you want East Devon District Council to use the Neighbourhood Plan for Dalwood to help it decide planning applications in the neighbourhood area?"
The results, confirmed in the published Declaration, are as follows:
Number cast in favour of a 'YES'
104 (95%)
Number cast in favour of a 'NO'
5 (5%)
Turnout: 31%

Examination
The Dalwood Neighbourhood Plan has been examined. The appointed independent examiner was Jill Kingaby. The conclusions of the examination were that, subject to a number of amendments, the Plan met the necessary 'Basic Conditions' and could proceed to referendum. The Examiner's Final Report is available to view.
In undertaking the examination, the Examiner considered a full set of Plan documentation, including all responses received to the Submission consultation (see under Submission heading below). In addition, consideration was given to a response from the Parish Council and District Council to questions posed by the Examiner.
The Plan has since been updated in line with the examiner’s recommendations. It was confirmed by formal decision of East Devon District Council in December 2021 that the Plan meets the necessary 'basic conditions' and could go forward to referendum.
Submission Consultation (Regulation 16)
Dalwood Parish Council (as the qualifying body) prepared and submitted the Dalwood Neighbourhood Development Plan (Submission Version) to East Devon District Council in April 2021. The District Council held an 8 week consultation inviting comments (representations) on the Plan. This consultation closed on 30th June 2021.

The District Council undertook a Legal Compliance Assessment of the submission. This assessed the Plan as able to proceed to this next stage of formal consultation (known as Regulation 16). The formal Notice of the consultation confirms the details.

East Devon District Council officers undertook a Screening Assessment on the draft Dalwood Neighbourhood Plan for Strategic Environmental Assessment (SEA) and Habitat Regulations Assessment (HRA). This concluded that neither an SEA or HRA were required.
Pre-Submission Consultation (Regulation 14)
Dalwood Parish Council consulted for 6 weeks on the pre-submission version of their Neighbourhood Plan, ending 3rd March 2020.

Neighbourhood Plan Designation
Dalwood Parish Council requested that the whole of their parish be designated a Neighbourhood Area. The designation was approved on the 30 August 2016.
