7. Broadclyst (made)

Adoption

On 20 July 2023, East Devon District Council decided to ‘make’ (adopt) the Broadclyst Neighbourhood Plan.  This means that it now forms part of the Development Plan for East Devon alongside any other made neighbourhood plans, the adopted East Devon Local Plan 2013-2031, and the Devon Minerals and Waste Plan.

This was following the successful referendum on 22 June 2023, where 88% of residents who voted were in favour of the Plan.

The Broadclyst Neighbourhood Plan as 'made' is available to view.  Appendices and supporting documents are available on the Broadclyst Parish Council website.

Our Decision Statement and Compliance Statement confirms the Plan as made and legally compliant.

The Plan will be used to help make decisions on planning applications and guide future development in the parish of Broadclyst.

Referendum

A local referendum was held on 22 June 2023 on the Broadclyst Neighbourhood Plan.  The referendum asked residents in the parish of Broadclyst the following question:

""Do you want East Devon District Council to use the Neighbourhood Plan for Broadclyst to help it decide planning applications in the neighbourhood area?"

The results, confirmed in the published Declaration, are as follows:

Number cast in favour of a 'YES':  494 (88%)
Number cast in favour of a 'NO':  71 (12%)
Turnout: 11.32%

Examination

The Broadclyst Neighbourhood Plan has been examined.  The appointed independent examiner was Andrew Ashcroft.   The conclusions of the examination were that, subject to a number of amendments, the Plan meets the necessary legal requirements, and can proceed to referendum.

In undertaking the examination, the Examiner considered a full set of relevant Plan documentation, including all responses received to the Submission consultation (see under Submission heading below).  In addition, consideration was given to responses from both Broadclyst Parish Council and East Devon District Council to questions posed by the Examiner in a Clarification Note: 

A clarification meeting was also held at the invitation of the Examiner with Broadclyst Parish Council and officers of East Devon District Council to discuss.   As a result, a further clarification note was supplied by EDDC to confirm the planning status of the proposed allocation site at Crannaford Crossing.

East Devon District Council considered and accepted all of the recommendations made by the Examiner at its Cabinet meeting of 29th March 2023.  A formal Decision Notice confirms the decision and recommended the Plan to go on to local referendum.

Submission Consultation (Regulation 16)

Broadclyst Parish Council (as the qualifying body) prepared and submitted the Broadclyst Neighbourhood Development Plan to East Devon District Council in June 2022.  The District Council undertook a Legal Compliance Assessment of the Submission which assessed it as compliant.  The District Council held a formal consultation (known as Regulation 16) inviting comments on the plan.  This was held over a 10 week period, closing on 8th September 2022.  The formal Notice of Consultation confirms the details.

All appendices to the Neighbourhood Plan, along with other reference and background documents, are available on the Parish Council website.  The District Council have supported the Parish Council to make the Submission documents as accessible as possible.  The Parish Council have also supplied an Accessibility Statement to accompany their submission.

Pre-Submission Consultation (Regulation 14)

Broadclyst Parish Council consulted on the Pre-Submission draft of the Broadclyst Neighbourhood Plan between December 2020 and February 2021.  The consultation closed for comments on 28th February 2021.  The Parish Council, supported by their technical experts at Aecom, updated the plan as a result of comments received and refined the plan further following a 'health check' by an independent examiner.  The consultation draft plan and supporting documents are available to view on the Parish Council website.  

Neighbourhood Plan Area Designation

A Revised Neighbourhood Area, covering the whole of Broadclyst Parish, was agreed by Cabinet on 13 July 2017 (the effective date of this decision is 20 July 2017).  This superseded the previous designation of part of the parish.
